The case against Nicholas Ninow continued on Wednesday, at the Pretoria High Court, with the testimony of the girl who was raped and her mother.
Nicholas Ninow: What’s the latest?
Ninow’s pre-sentence hearing continued with the private testimony of the victim. The eight-year-old was grilled for about an hour on what she could recall from that dreadful September afternoon.
The contents of her testimony were not shared with the media and the public, a decision that was made by the judge after the State applied for her broadcast to be shown in court without an audience.
Her mother too, whose testimony was also broadcast so as to protect her and the victim’s identity and dignity, took the opportunity to share the gory details of what had happened at the Dros restaurant in Silverton, Pretoria, on 22 September 2018.
What we learned from the mother’s testimony
She recalled every single detail of how she had discovered her daughter in the restaurant’s women’s toilet, locked in one of the three cubicles with Ninow.
The mother, according to SABC journalist, Liela Magnus, revealed that her daughter was wearing maroon tights beneath a blue skirt that had white polka dots, a matching blue t-shirt and maroon sneakers the last time she saw her playing at the kiddies corner.
However, after a brief scuffle with Ninow, who had repeatedly shouted “you are disturbing me” as she and the child minder were trying to shove the cubicle door open, the mother recalled seeing her child only dressed in the skirt and t-shirt.
Ninow, clearly busted, had managed to run into the men’s toilet.
“I handed my child to a lady and went to the men’s toilet and I [found] him cleaning himself with the child’s clothes – he was cleaning his penis with the child’s panty,” she said.
The mother recalled seeing Ninow flush the victim’s underwear down the toilet. When she asked him why he was doing that, the mother said Ninow did not respond.
“There is no parent that should see what I saw, Emotionally I am not okay with what I witnessed,” she added.
Court shown images of the rape cubicle
Under cross examination, the mother revealed that her daughter had blood on her skirt, assuming that it belonged to her daughter. Ninow, she said, was completely naked.
The court was shown two images of the bloody cubicle. The first image showed the victim’s maroon tights sprawled on the floor, next to droplets of blood and Ninow’s belt and cigarettes.
After admitting that she and her daughter would require long-term counselling, Ninow’s legal representative, Herman Alberts closed off his cross examination.
Both sides, the State and the defence, have since rested their case. Court proceedings are expected to resume on Thursday, where both sides are expected to present their arguments.
