Watch: Man filmed beating and kicking his wife – avoids jail

It’s enough to turn your stomach: Barry Bateman, AfriForum’s Communication Officer for their Private Prosecution Unit, has been left outraged by the verdict handed down in a GBV case on Tuesday – after damning video evidence against Jaco Swart was omitted from proceedings.

Swart, a business-owner who shamelessly referred to himself as ‘hooligan’, was captured on CCTV attacking his now-estranged wife in merciless fashion. He delivered a series of punches and flying kicks to his partner, and for all the world, this looked like an open and shut case.

AFRIFORUM DISAPPOINTED WITH JACO SWART SENTENCE

Inexplicably, this case was initially dropped by the NPA last year, before AfriForum pursued their own private prosecution. Despite building a water-tight case, the group fell at the final hurdle – failing to put Jaco Swart behind bars.

Their efforts did result in several punitive measures, but Bateman and his colleagues feel that justice has not been done for Nicoleen Swart.

  • Jaco Swart was given a R20 000 fine by the judge on Tuesday, after pleading guilty to the charges.
  • The court also dished out a SUSPENDED jail sentence of three years, which will remain in place until 2027.
  • However, Swart was not sentenced to an EFFECTIVE jail term, which would have incarcerated him. That will only happen if he re-offends.
  • So, just to be clear, that bloke we just saw kicking and punching the living daylights out of a woman is now a free man…
